Sales Terms

OVERVIEW

Before completing your order at beyoufurniture.com, please carefully read these legal conditions of supply (these “Sales Terms”) and the Terms of Service (the “Agreement”). These Sales Terms form a part of, are incorporated into, and are subject to the Agreement and constitute “Additional Terms” thereunder.  

THESE SALES TERMS TOGETHER WITH THE AGREEMENT GOVERN YOUR

PURCHASES FROM BEYOUFURNITURE.COM ON THE BEYOUFURNITURE.COM WEBSITE (THE “WEBSITE). BY CLICKING “PAY NOW” WHEN YOU PURCHASE, OR OTHERWISE PURCHASING PRODUCTS FROM THE WEBSITE (THE “PRODUCTS”), YOU ARE ENTERING INTO AND AGREE TO BE BOUND BY THESE SALES TERMS AS WELL AS THE AGREEMENT. If these Sales Terms are inconsistent with the Agreement, these Sales Terms shall control with respect to the purchase of products from the Website. Capitalized terms used, but not defined herein, shall have the meanings prescribed to them in the Agreement.

You are encouraged to save and print the Agreement and these Sales Terms for future reference. The Company may also keep an electronic record of your acceptance of the Agreement and these Sales Terms. 

SECTION 11 OF THE AGREEMENT CONTAINS AN ARBITRATION AGREEMENT THAT APPLIES TO THESE SALE TERMS AS WELL AS THE AGREEMENT AND WILL, WITH THE LIMITED EXCEPTIONS SET FORTH THEREIN, REQUIRE DISPUTES BETWEEN YOU AND THE COMPANY, INCLUDING DISPUTES ARISING UNDER THESE SALE TERMS, TO BE SUBMITTED TO BINDING ARBITRATION. UNLESS YOU OPT OUT: (I) YOU WILL ONLY BE PERMITTED TO PURSUE DISPUTES AND SEEK RELIEF AGAINST THE COMPANY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING; AND (II) YOU ARE WAIVING YOUR RIGHT TO PURSUE DISPUTES OR CLAIMS AND SEEK RELIEF IN A COURT OF LAW AND TO HAVE A JURY TRIAL. 

ANY DISPUTE, CLAIM OR REQUEST FOR RELIEF RELATING IN ANY WAY TO YOUR USE OF THE WEBSITE OR YOUR PURCHASE OF PRODUCTS WILL BE GOVERNED AND INTERPRETED BY AND UNDER THE LAWS OF THE STATE OF DELAWARE, CONSISTENT WITH THE FEDERAL ARBITRATION ACT, WITHOUT GIVING EFFECT TO ANY PRINCIPLES THAT PROVIDE FOR THE APPLICATION OF THE LAW OF ANY OTHER JURISDICTION. THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS IS EXPRESSLY EXCLUDED FROM THIS AGREEMENT. 

The products available on the Website are available for purchase only by consumers who are at least over the age of majority in your state or province of residence. If you are below the age of majority in your state or province of residence, please ask your parent or guardian to review these Sales Terms and place the order for you.

If you are buying products for a business or on behalf of a business, please contact the Company via the Contact page. The product warranties given under these Sales Terms do not apply to any: 

- corporate purchases;

- products that are acquired for commercial purposes; 

- crowdfunding / pre-order backings; or

- any gift redemptions.

Beyoufurniture.com 651 N Broad Street, Middletown 19709, New Castle, USA, is the seller of the products. You can contact us at contact@beyoufurniture.com.

2. Website presentation

We work hard to make sure that the Website content is correct at all times. However, it is inevitable that mistakes may occur. We may make a mistake in a product description or fail to update the price every once in a while. We reserve the right to correct our mistakes, errors or omissions by either cancelling your order or offering you alternative options. If a pricing error is obvious, you agree that we don’t have to sell you the Products at the incorrect (lower) price. You will always have the right to cancel your order after we alert you of our mistake.

Due to technology limitations and the use of manual assembly for some parts of our products, you should be aware that actual products may vary slightly from their images in the Website. However, these variations should not be major. 

The Website is solely for the promotion of our Products online. Our Products are intended to comply with the applicable Federal laws and the applicable state laws and regulations. 

All products displayed at the Website are subject to availability and we reserve the right to remove or amend the availability of a Product from the Website at any time, or to otherwise limit the products that each order, account, credit card, person or household can buy. We also reserve the right to revise the pricing of any Product on the Website at any time.

3. Your consumer rights

Product Warranty

The Company provides a limited 1 year manufacturer’s warranty. Please note that our manufacturer’s warranty is in addition to, and does not replace, any statutory rights you may have as a consumer under the applicable Federal laws and the state laws.

Should you find that a Product is faulty or defective, you have the right to return it to us to be repaired, replaced or refunded. Please review our manufacturer’s warranty for more details. 

This does not apply to promotional offers including but not limited to special offers, discount offers, crowdfunding, pre-orders or any other type of promotional offers the Company and its affiliates choose to run from time to time. For more details about this please see Promotional Terms.

Cancellation

You have the right to cancel your order for any reason as long as you exercise this right within 90 days of receiving the Product. Please review our Return Policy for more details.

This does not apply to promotional offers including but not limited to special offers, discount offers, crowdfunding, pre-orders or any other type of promotional offers the Company and its affiliates choose to run from time to time. For more details about this please see Promotional Terms.

4. Ordering and Shipping

Order placement 

When placing an order through the Website, you agree to provide accurate and complete information, including your name, shipping address, billing address and payment information (“Buyer Information”). By submitting the Buyer Information, you represent that the information you have provided is true, valid, complete and up-to-date in all respects, and that you have not entered the information of another person who has not given you any authority to act on such other person’s behalf. The Company reserves the right to refuse or cancel any order at its discretion.

You agree that the Company may collect, store, secure, use, disclose, retain and maintain the Buyer Information in accordance with the privacy practices described in the Privacy Notice. If you have entered the Buyer Information on behalf of another individual, you represent that such individual has given you the consent to transfer her or his personal information to the Company and that such individual agrees to Company’s processing of their information in accordance with the privacy practices described in the Privacy Policy.

Order confirmation 

Please take the time to ensure the accuracy of your order before completing your payment. Once you click on the ‘Pay Now’ button or its equivalent, you will have made a binding and irrevocable offer to buy the Products from the Company. 

After you have placed your order, we will verify your payment before issuing an order confirmation to you via e-mail. You hereby consent to receive communications from us electronically, and such communications satisfy any legal requirement that the communications be in writing. As part of beyoufurniture.com’s payment processing protocol, we may collect additional information about you, directly or through third party providers, for security and anti-fraud purposes. 

Once we have successfully verified your payment, we will debit your selected payment method. Please note that we will process your payment at the time of placing the order.  

Upon receipt of your order, the Company may send you an order confirmation email with the details of your order. This email does not constitute acceptance of your order, but rather confirms that the Company has received it. 

Acceptance and Contract Formation

The acceptance of your order and the formation of a contract between you and the Company will occur when the Company dispatches the ordered product(s) and sends you a shipping confirmation email, including tracking details. The Company reserves the right to reject or cancel your order for various reasons, including but not limited to product unavailability or suspicion of fraudulent activity. 

Crowdfunding/Pre-order Model

We offer our customers the possibility, from time to time, to place advance orders, through Crowdfunding/Pre-order campaigns and offers that run through the Website or through third party websites specifically chosen by the Company, for specific goods. For Crowdfunding/Pre-order campaigns and offers, specific terms apply and they can be found in the Crowdfunding/Pre-order Terms. 

For orders placed in advance through Crowdfunding/Pre-order campaigns and offers, the shipping and handling costs will be charged at a later date, before the order is shipped. Shipping and handling costs and delivery times, provided at the moment the advance payment for the product is made, are estimated and subject to various factors. Please refer to the specific campaign details for more information. 

Direct Purchase

For orders that are not part of a Crowdfunding/Pre-order campaign and offer, placed directly through the Website, shipping costs will be clearly displayed and added to the product price before checkout. The product will be delivered within 5 to 10 business days from the moment a tracking number is issued, unless otherwise specified. 

If your payment is not processed as described in Section 7 (Payment), or if your payment does not pass the security checks, we will reject your order. In some cases, this can happen after you receive an order confirmation. If your order is rejected, the sales contract between you and the Company is cancelled without any liability to either you or the Company. 

The Company may reject any order for any reason. Where that is the case, we will let you know via e-mail, and will refund you the full amount that you have paid (if any).

5. Delivery

Sales Direct to Consumers

The Company sells products directly to individual consumers through its Website and not only. The terms and conditions outlined in this Agreement primarily apply to direct sales to consumers. Businesses interested in purchasing Company’s products are advised to contact the Company to discuss their specific requirements and terms applicable to corporate clients.

International delivery 

We offer international delivery to over 25 countries, including countries within the European Economic Area. We dispatch orders from our fulfillment facilities located worldwide, using different carriers based on efficiency and cost-effectiveness. Please note that our delivery methods do not include unpacking, assembly, or removal of packing materials. The shipping and handling price is calculated based on the weight, dimensions of the product, and the destination country. The shipping and handling price will be: (I) displayed during the checkout process for direct orders that will be delivered within 5 to 10 business day from the moment a tracking number is issued, or (II) provided as estimated shipping and handling price during Crowdfunding/Pre-order campaigns and offers. 

There may be limits to where the Company can ship the products. If your shipping address is outside of our delivery zone, we will let you know before you place the order and you will not be able to proceed to checkout. 

Unless otherwise stated on the Website, the prices shown on the Website do not include shipping and handling fees. Shipping and handling fees, if any, are calculated after you have provided your shipping address and will be displayed at checkout for normal orders, not for Crowdfunding/Pre-order campaigns and offers. 

Delivery Times

Delivery times may vary, but on average, it takes 5 to 10 business days, from the moment the tracking number is issued, for direct orders, not the ones placed in a Crowdfunding/Pre-order campaign and offer, to reach their destinations. Please note that these timelines are based on business days (Monday to Friday), and delays can occur beyond our control. 

The estimated shipment arrival date will be included in the shipment confirmation sent to you. Sometimes, an event beyond the control of the Company may delay the shipment of your order. Should that happen, you will receive an updated delivery date as soon as it is available. Please note that any estimated delivery dates displayed on the Website, in Crowdfunding/Pre-order campaigns and offers, or in any order confirmation e-mail, are simply estimates – they do not represent a guarantee that the products will arrive by that delivery estimate. Delivery is completed when the products reach the shipping address you provided to the Company at the time of placing the order, in the case of a direct purchase, or at the time of shipping and handling fee collection in the case of Crowdfunding/Pro-order campaigns and offers. 

The risk of loss and title for the products pass to you upon our delivery to the carrier. The Company is not responsible for any damage or loss that occurs during delivery.

Order Fulfillment

Once an order has been shipped, we are unable to make changes to the shipping address. It is the customer's responsibility to provide complete and accurate shipping information. We cannot and will not be held liable for packages lost or returned to the sender due to incomplete or inaccurate addresses.

Delivery Delays

We are committed to delivering every product ordered through our Website. If you do not receive your order within the estimated delivery timeline, please contact us. Please note that additional time may be required for delivery, especially during busy periods or in cases where the local mailing service is less efficient.

6. Prices and promotions

Unless stated otherwise, prices shown in the Website do not include any applicable sales tax. You are responsible for paying the state sales tax and any other taxes, levies or duties imposed on the purchasers in connection with your purchase of products from the Website. To the extent we are obligated to collect any such additional taxes, the applicable tax will be added to the total price at checkout.

We may adjust product prices from time to time. Changes in price will not affect any order for which the Company has issued an order confirmation.

We run many promotions on the Website, or third party websites, and reserve the right to alter the terms or duration of any promotion.

7. Payment

Credit, Debit Cards and Electronic Accounts

By submitting an order and providing the Company with your payment details at checkout, you authorize the Company (acting by and through our payment processor) to charge the relevant account to take payment for your order at the time of placing the order. The Company will not be responsible for any losses you may suffer if the payment method you use to pay for an order does not have sufficient funds to cover all costs of that order.

8. Limitations to Company’s liability to you

If the Company fails to comply with these Sales Terms, the Company is only responsible for loss or damage you suffer that is a foreseeable result of us breaching these Sales Terms or failing to act with reasonable care and skill. The Company is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is either obvious that it will happen or if, at the time these Sales Terms are entered into, both the Company and you knew it might happen.

We supply the products solely for domestic or private use. You agree not to use a product for any commercial, business or resale purpose, and should you do so, we will not be liable for any economic loss you may suffer, such economic loss includes but is not limited to loss of profit, loss of business, business interruption or loss of business opportunity. In no event will the Company be liable for any consequential, special, indirect, incidental or punitive damages, however caused, whether by the negligence of Company or otherwise.

Nothing in these Sales Terms is meant to exclude or limit in any way Company’s liability to you where it would be unlawful to do so under applicable laws.

Company’s liability to you under these Sales Terms shall not exceed the purchase price of the product(s) paid by you.

9. Events outside the Company’s control

The Company shall not be liable for delays or failures to perform our obligations due to events outside the Company’s reasonable control. Examples of these events include but are not limited to labour disputes, industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war, acts of God, epidemics or pandemics, supply chain disruptions, malicious damage, accidents, failure of public or private telecommunications networks, impossibility of the use of shipping, aircraft, motor transport or other means of public or private transport or compliance with any laws or government orders.

If an event outside of Company’s reasonable control takes place that affects the Company’s performance of Company’s obligations to you:

  1. the Company will let you know as soon as reasonably possible; and
  2. Company’s obligations are suspended and the time for performance of our obligations will be extended for the duration of such an event.

Where the event affects the Company’s delivery of products to you, the Company will arrange a new delivery date with you after the event is over.

10. Customer service / Complaints handling

The Company will do its best to resolve any complaints or disputes relating to product purchases or these Sales Terms.

11. Changes to these Sales Terms

The Company may revise these Sales Terms from time to time. The Sales Terms in force at the time you place your order serve as the transaction contract between the Company and you on that order.

Please review the Sales Terms each time you purchase from the Website.

12. Other important terms

We may transfer our rights and obligations under a sales contract to another organization. Such a transfer will not affect your rights or our obligations under these Sales Terms.

The sales contract is between you and beyoufurniture.com. No other person shall have any rights to enforce any of its terms.

Each of the provisions of these Sales Terms operates separately. If any court or relevant authority decides that any of the provisions are unlawful or unenforceable, the remaining provisions will remain in full force and effect.

If beyoufurniture.com fails to insist that you perform any of your obligations under these Sales Terms, or if beyoufurniture.com delays enforcing beyoufurniture.com’s rights, that shall not mean that beyoufurniture.com waived beyoufurniture.com’s rights against you. You must continue to perform your obligations even under these circumstances. If beyoufurniture.com waives a default by you, we will only do so in writing. Just because beyoufurniture.com waived your default once does not mean that beyoufurniture.com will automatically waive any later default by you.

These Sales Terms are subject to the terms and conditions of the Agreement, including all terms related to dispute resolution and arbitration, notice, and governing law.

13. Returns and Refunds

Return Policy

The Company's return and refund policies are subject to applicable laws and regulations. In the event of any conflict between our policies and any applicable regulation in a state of the United States, the relevant state regulation will supersede and govern the return and refund process to the extent required by law. Our policies will apply in all other circumstances not superseded by applicable state regulations. While the Company strives to provide a satisfactory customer experience, certain consumer protection laws may apply, and the Company will comply with such laws. For specific information on returns and refunds, please refer to the Return Policy section on the Website.

Involuntary returns

If your order is processed correctly on our site and cannot be delivered due to unavailability or failure to collect it from the post/courier office, the package will be returned to us after a waiting period. We cannot be held responsible for involuntary returns. If you wish to have the package resent, you will be responsible for covering the additional fees incurred due to its return.

Voluntary returns

If you wish to return a damaged item, please contact us within 24 hours of receiving your order. Upon receipt of the returned item, we will either repair or exchange the product. We recommend using a trackable shipping service and obtaining insurance for the return. We are not responsible for lost packages during the return process.

Physical Stores 

The Company currently operates exclusively through the Website and does not have any physical stores. Information about the availability of physical stores will be communicated on the Website if and when applicable.

14. Limited Warranty

We offer a 1-year limited warranty on manufacturing defects. If you experience any issues with your product, please email us contact@beyoufurniture.com for assistance. We will repair or replace all defective Products/Parts. 

Please note that items bought as part of Crowdfunding/Pre-order campaigns and offers, special promotions or clearance sales cannot be refunded or returned. 

If the Product is received damaged please inform us within 24 hours of receiving the product.

Your warranty starts from the date you received your Product. Your date of receipt will be the date shown on our delivery records for your order.

Warranty claim process

  • When making a warranty claim please provide your order number to validate your warranty.
  • Submit your claim to contact@beyoufurniture.com.
  • In your claim please provide clear pictures and video of the alleged defect. 
  • A video call with our technical team will be set, so we can properly analyze what is the situation. 

If you refuse to provide pictures of the alleged defect and if you refuse to have a video call with our technical team, we may assume that you cannot substantiate your claim or you have abandoned the claim.

Our warranty enables you to service your own Product. If faulty parts are identified we will ship the replacement parts to you free of charge, and provide you with the necessary installation or assembly instructions. You may replace the parts by yourself or through a third party, but we won't be responsible for any labour costs due to the replacement.

Replacement parts may vary slightly in looks from what you bought because some of our parts are finished by hand. Replacement items will be warranted until the end of the warranty period for the originals which they replaced or 30 days from the date you receive the replacement items, whichever is later.

If we need you to return defective parts or goods to us, we will pick up the defective

parts or goods from you at our own cost or we will provide you with shipping instructions to

ship the defective parts or goods back to us at our own cost.

If you need us to repair or replace a part or a product that is out of warranty, you will pay for all the costs of repair and replacement. Examples of these costs may include but are not limited to handling, transport, packaging and shipment charges and customs duty.

If, after a reasonable number of attempts, we are not able to fix the defects in the Products/Parts, we will replace the Products/Parts or reimburse you in an amount equal to the purchase price you paid less that amount directly attributable to use by you prior to the discovery of the nonconformity.

Warranty transferability limitation

Beyoufurniture.com warranty applies to the original purchaser only. All subsequent owners of the Product acquire it "as is". Any attempt to transfer any warranty in violation of this

paragraph will void the warranty.
